Terms & Conditions
Our primary market is the commercial foodservice operator including restaurants, healthcare, taverns, bars, schools, clubs, etc., but we also welcome the aspiring home chef! Our products are priced to be super competitive for commercial users so you will be impressed with how much you can save at Liberty*Mart! Our products are commercial in nature - usually of heavier construction and more durable - and may not have the same fit and finish that you might expect from retail grade merchandise. Additionally, some appliances may not be appropriate for consumer use. Contact Liberty*Mart if you have questions or concerns. |
Payment
We accept cash, VISA, MasterCard, Discover, AMEX, money orders and cashiers checks. Personal and corporate checks are also welcome, but may be subject to bank clearance. All funds payable in US dollars. Minimum order is $25.00. No extra charge for credit card orders. Taxes vary by state and county and will be added to your invoice as required by law. Even though Liberty*Mart may not have a physical presence in your state, many or our manufacturers do and are obligated to add the respective sales tax or fee when the product is shipped direct to you. These taxes will be added to your invoice and become part of the total sale price. |
Delivery
In addition to our four (4) regional warehouses, we sometimes ship direct from the manufacturer to you. Stocked goods from our warehouses generally ship within 24 hours of receiving your order. Standard goods direct from the manufacturer usually take 1 – 3 business days to ship. Made-to-order items from the manufacturer can take up to 12 weeks in some cases. If time is of the essence, please call us for a more accurate lead time which can vary depending on the product and the manufacturer. All prices are FOB Liberty*Mart warehouse or manufacturer’s shipping point. Shipping and handling fees will be applied to your purchase unless otherwise noted. Prices & Availablity
Due to fluctuations in world markets for many of the raw materials that go into the manufacturing of foodservice goods, prices and availability are subject to change with out notice. If pricing fluctuations are small, Liberty*Mart will often absorb the increases. For larger adjustments, we will request approval prior to shipping. Liberty*Mart is not responsible for typographical or photographic errors, for merchandise that might be discontinued or unavailable from the manufacturer, or for representations made or implied by the manufacturer.

Lost / Damaged Goods
| Merchandise becomes the property of the customer when picked up by the carrier be it a trucking company, parcel service, or US Mail. The carrier is responsible for safe arrival to your specified location, therefore, inspect and make note of any damages or discrepancies on the freight bill next to your signature before you sign it. You are acknowledging that your merchandise was received in good condition without any damages or shortages. If the driver will not wait for your inspection, note this on the bill next to your signature. Sometimes concealed damage occurs which is not evident until the package is opened. This must be reported immediately to the carrier and inspection requested within 15 days of receipt. File your claim with the carrier and be sure to save all packing and crating materials for their inspection. If these guidelines are not followed, your opportunity for recovery from the carrier will be limited. Warranties
| We honor all manufacturers’ warranties against factory defects in materials and/or workmanship. Do not return defective merchandise to Liberty*Mart. Service is handled by the manufacturer’s service agent, and we are happy to assist you if you have a problem that cannot be resolved with the service company or manufacturer. Under no circumstances will consequential damages be considered and there are no implied warranties of merchantability or fitness for a particular purpose. |
Customer Shipping / Handling Cost Savings
All merchandise is packaged to arrive via common carriers, which include trucking companies, parcel services, and US Mail. Shipping charges vary and are based upon the class of freight, weight, volume, origination point and destination. Because of our large sales volume, we are often able to save our customers extra dollars on truck shipping and handling costs. Generally, the larger your order, the more cost effective your shipping and handling costs will be. Trucking companies are obligated to provide end of truck delivery only and will often assist if you have a standard height dock. If the carrier attempts to deliver and is unable to for any reason within your control, re-delivery fees may apply. Lift gate deliveries or other special services are available at additional cost and must be quoted and accepted at the time your order is placed. Carriers require a physical address so PO boxes cannot be accepted.

Returns and Cancellation
Stocked merchandise from any of our Liberty*Mart warehouses may be returned within 7 days from date of purchase provided it is still new and unused with all original packaging, literature and related parts and components. An item is considered “delivered” if it is still in our warehouse 30 days after the date of purchase. All returns must be shipped prepaid and all are subject to a minimum 30% restocking charge plus any damages that may occur in transit. Contact Liberty*Mart for a Return Authorization number (RA), which must be written on the box and paperwork so we can track and process your return. Direct shipped merchandise from any of our suppliers can not be returned without an RA, and only if the supplier will accept the return – usually with restocking charges of 25 – 50% plus inbound and outbound freights. Any damages incurred in transit will be the buyer’s responsibility. Be sure to contact Liberty*Mart to obtain the RA prior to returning the merchandise. Special order and made-to-order merchandise may not be cancelled or returned depending on that specific manufacturer’s policy. In rare cases, their restocking fees may be up to 100% if the product was of a custom nature. Please contact Liberty*Mart if you suspect that a problem with acceptance might arise and we will try our best to minimize the cost of cancellation. Used items are not returnable. |
